66(A) of IT Act and facebook




What is Section 66 (A) of the Information Technology (IT) Act?


An analysis of  section 66 (A) of the Information Technology (IT) Act clearly elucidate the following cyber crime which have covered under this section: Cyber Stalking(Stealthily Following a person, tracking his internet chats),E-Mail Bombing(Flooding an E-mail box with innumerable number of E-mails, to disable to notice important message at times.)Identity Theft(Stealing cyberspace identity information of individual)Worms Trojan Horses, Virus etc, Different Hacking mechanisms,Web Defacing(Web Pages Defacing).

How sec 66(a) related to facebook ?

The section restrict a net user not to publish any message,comment or any other activity  that is offensive or that is malicious in nature, by  using online communication resources or devices.Therefore when a facebook profile holder post/write/comment or share a content (image/text etc) ,this attract the 66 (a) of IT Act

What is new guideline on Sec 66(a) of IT Act?

New guidelines are just related  to enforcement mechanism of IT Act specially Sec 66(A) like who is competent to execute the arrest etc .For example previous permission of  Deputy Commissioner of Police in rural areas and Inspector-General in metros is necessary before registering and complaint in police station .

Punishment in case of Violation of Sec 66(a) of IT Act?

An offender may be punished be three year imprisonment with or without fine .
